
ConcertX: How does the law need to be adapted when concerts go digital?
Digital experiences are increasingly complex and advanced, and increasingly resemble the real world. This gives many more people access to powerful experiences through live concerts and performances. Artists and performers also receive more sources of income and channels while new technologies and new services are developed. Technological developments lead to legal issues such as copyright, privacy and data protection. At the same time, it is also important to review certain rules so that they do not slow down the pace of innovation but instead facilitate technology implementation and co-creation. The ConcertX project will develop specific legal tools for the growing field of technological and cultural innovation around personal, digital and immersive concert experiences.
During the Corona pandemic, it suddenly became possible for a wider audience to gain cultural experiences digitally. Future by Lund is co-coordinating the innovation portfolio “Personalised digital concerts” which aims to enable live events to be streamed where the “digital” audience has control over who and what to zoom in on, not only in terms of image but also audio-wise. The portfolio brings together Malmö Live, companies that Axial Communication, Amazonas and Sony as well as six faculties at Lund University, including the artistic, legal, economic and technical, in a joint exploration and creation.
In 2023, Lund University was granted funding for the project Lund University Digital Interactive Concert Hall (LUDICH) which is part of the Innovation Portfolio, bringing together actors from different sectors to develop technical, entrepreneurial, artistic, educational and social aspects of digital, immersive and individualised concert experiences. Added to this is the new project KonsertX, which examines the legal possibilities and consequences of digital cultural experiences. ConcertX's ambition is to develop specific legal tools for the innovation portfolio. Through this project, the Faculty of Law is brought together with the faculties of Arts at Lund University. Future by Lund is also part of the partnership.
Modern technology provides an opportunity for increased access, individualization and democratization of cultural expressions, such as live concerts and performances. Suddenly, an audience, previously unable to attend in person, is able to partake of the performances. For artists and artists, it becomes an opportunity for new sources of income, new audiences and new channels for their artistic expression. Companies gain opportunities to develop modern services and further update technology, which in turn makes digital live experiences even more sophisticated. The digital transformation will change a lot, including legal norms. Different ways will be needed to ensure respect for intellectual property rights and data issues. KONSERTX will highlight compliance needs related to legal regulations (intellectual property and data) but also aims to find ways to support innovation and overcome barriers to adaptation and acceptance of modern technologies so as not to slow down the pace of innovation and so that business opportunities are not stopped.
In connection with the live, immersive and individualized concert experiences, KonsertX will investigate:
*Uncertainties in the distribution of copyright, protection of the artistic integrity of the work, compensation for the non-profit and economic rights of authors and performers in EU/Swedish copyright law, strategies to facilitate technology implementation and co-creation.
*Compliance and governance practices for data protection, data sharing and data use.
*Solutions that take into account the experiences and expectations of relevant actors and offer a workable balance between the rights, obligations and legitimate interests of commercial actors, institutional actors, artists and audiences.
